What say you? Who damaged this cab?

I have purchased a Star Wars Trilogy off of a fellow KLOVer. The unit was picked up through NAVL (Beltman/STI). The unit arrived with the right side caved in. What I found odd about this situation is that delivery man rotated the cabinet so that the damaged side was facing away from me and he rolled it into my driveway (Cabinet is on casters). He then propped the machine against one of my other cabinets waiting in line to be brought into the basement arcade. The delivery man rushed me for payment and signature. He claimed he was in a rush. This was not out of the ordinary considering this was the same delivery man for the past 2.5 years and I somewhat trusted him. I just assumed everything was fine. As the delivery man drove off, I rotated the cabinet and my eyes almost popped out. The right side was caved in. I noticed that the stretch film around the damaged area was also damaged. I took numerous pics and filed a claim with STI. I just received the attached letter stating the claim was being denied. No additional documentation accompanied the letter. I submitted a letter via email and sending certified tomorrow am. In their letter they claim the excessive damaged was documented at time of pickup. In my response to the company I requested a copy of this documentation. It is hard to believe I bought the cab like this. I analyzed this damage on several occasions (The game is still wrapped). It looks as though a forklift rammed into it. What do you guys think? Btw, I am so frigggggggggggggin pissed.

Looks like a delivery mishap, and that driver is a tool for basically tricking you. However, shame on you for not doing a 360 before accepting delivery. I've had delivery guys pull the same "I'm in a hurry" shit before; that makes me go slower because I suspect something then.
 
Have you contacted the seller? Maybe he has pictures of the game before it was shipped. Based on the shipping horror stories I have seen I sure the hell would have a pile of pictures on the condition before pickup and probably during pickup.

id say go after the freight co. on this one. if i saw something like that in my driveway, id be mad as hell and would not sign anything!!
 
I too have to say the delivery people did it. Come on... the shrink wrap is broken...the shrink wrap the DELIVERY PEOPLE put on the cab....

Chances are, he was the the one that smashed it when he transferred it to his truck otherwise he would have been all over telling you "it was like that when it was delivered to me".

You have now learned the "never, ever sign anything until you have counted it and verified that it is the right stuff" lesson.

The thing you have working for you right now is the fact they acknowledge the damage was there when you got it. They cant turn around and say otherwise like you did it. So now you just have to prove that there wasnt any damage before it shipped. You kinda got a little lucky even though its a shitty situation.

edit: Try your best to get the pictures they say they took at time of pickup when damage was supposed to already be there.
 
It looks like they used the heavy duty ratchet strap and added too much tension when secured it on the trailer. Truck hits a pothole in transit and the particle board pops.

Your 4th picture shows the typical damage from straps under too much tension. Notice that there does not appear to be any impact marks that you would find from forklift forks.
 
You will get nothing and you will like it! I shipped a truck full of machines from florida to NY, they were to stay in the same trailer, NOT! They changed trailers all my shit got smashed to hell, They offered me 250.00 Not there problem, used items,

I had a case once with North American Van Lines over some "missing" jewelry (i.e. a driver stole it). Filed the claim and they denied denied denied. Sued in the general district court. They removed to Federal Court to try to better their leverage. They ended up settling for $10,000 once it became evident the legal fees would far outweigh the benefits. The point is, don't expect them to roll over. I'd say go ahead and file suit if they don't reimburse you. At the very least you'll make them pay in atty fees. You might get all your money back too.
 
I never normally sign for something without inspecting it first. Everyone was in a rush...I was...he was...I knew him. Never again. But all is not lost! If the trucking company can provide the documentation, then why didn't they tell me it was damaged upon delivery? If they do not provide the documentation, I am filing a formal complaint with the BBB as well as going to small claims court. If they do provide the documentation, well then...That is a different story.

Needless to say no matter if I know the person or not I will never sign for something without carefully inspecting it.

I submitted a formal response and am waiting a reply. either way, I feel they are stroking me

The corner protectors on both sides are both broken which would make more sense based on your observation.

The only issue is this is a case for small claims. There is a gray area here. I ordered the item through the internet but paid for delivery in my home town. I need to contact small claims and see if I can file locally. If not, they have a facility in NJ. I will take a day off and file a case in the closest court in NJ. I am pissed and I am not rolling over.

As previously stated, that's ratchet strap damage and the driver tried to conceal it from you. You are facing an uphill battle because you signed for it, the driver can claim you did it. I doubt you'll ever see any pictures that show damage when it was picked up. I suggest a follow up letter about the specific type of damage and the situation. Along with clear steps you plan to take if they don't work with you to resolve the issue. Hello small claims and BBB. Good luck.
