They stole my picture and are using it on their website

I guess it's not illegal since my picture isn't copyrighted, but it seems they should have at least asked for permission.

Call the number and ask them if they have any pictures of their products. When they tell you to look at the picture on their website, tell them, "But that's a picture of MY games that you are using without my permission."

Then make them build you some free cabs....
 
Wow - definitely your pic; right down to the corner protector on the Galaga.

If you took that picture originally, I believe there is an inherent copyright on it. You should find a cease and desist document somewhere on the web and modify it to apply to this situation, and mail it certified letter to them...

someone pointed this guy out to me making repro cabs.. i saw his stuff on ebay too. If you don't worry about things like oh, accuracy then he's your guy lol!

That is correct, if you took the picture then you have copyright on it!! I second contacting them with a cease and desist, or make them pay you some royalties!!

That happened to me on KLOV, a lot of the exidy pictures etc are of my machines.
(chiller, crossbow, top secret, mousetrap, venture, pepper ii, even quantum and more).

I thought it was funny cause I listed a game on ebay using the KLOV description and they emailed me to stop using their text. I basically said... You're using my pix, why cant I use your text?... never heard from them again :)

In the US, Copyright attaches as soon as you take the picture, so that's not the problem. If you actually wanted to go to court, you'd need to register the copyright with the copyright office, which costs a few dollars, but again, is not the problem.

The problem is that you don't have any muscle (legally). That is to say, you don't have the cash to throw at a lawyer. On the other hand, if they are building cabs and not showing their own pictures, then neither do they.

I'd say send them a letter and let them know you're aware of what they've done, and there is some chance that they'll back down.

Of course, the fact that they used scammed images instead of images of their actual products indicates to me that they aren't on the level, and I'd say that no one should buy from them. But that's just my opinion.

Oh look, their 'our photos' link now leads to a page of broken link icons. Fancy that.
 
I don't think that will help him. The pic they are using is not located on his site. I did have a guy do that to me in a once. I dl'd a pic of him from his website and added a few choice words to it and put the pic on my website at that link. Boy, did he get mad! I got all kinds of cease and desist stuff


Replace the picture at that link with one of gay porn...

I have had to deal with a lot of this type of thing and usually if you just call or email (I prefer calling) and tell him it's your pic and tell him what you want him to do/not do, usually they do it. Just make it a business call don't get mad.

How did you find this out?

I would simply e-mail them and tell them to stop. I have had similar happen at work with our products.

I did send him an email and basically said he should have asked for permission. The way it is displayed implies they are games that they built. It would be nice if they gave credit where credit was due, since they did not bother to ask ahead of time. That's it. No big deal.
