It's interesting that Universal lost, because they did seem to have the rights to Kong, and the game obviously took from the Kong story. A pretty blatant knockoff, really.
 
And to add to the story, one of Nintendo of America's lawyers in their defense was John Kirby. They named a certain Nintendo character in honor of him

Apparently there was some sort of question about the rights at the time. The character was created specifically for the movie business and there were movies made shortly before DK, so it's strange that the rights lasped or whatever was the case.

Worth mentioning: the official King Kong video game for the Atari 2600 is just a clone of Donkey Kong. Nintendo could have sued them and won, but they didn't.
