Paypal advice needed

This isn't for me, but for my sister. She sold an expensive piece of photo equipment on ebay, and the typical paypal bull poo occured. Winner receives it, decides he wants to screw my sister b/c it is a used item. Now she is out $800 and no item. Paypal has told her that there is a 30 day hold on her funds and paypal account. They actually pulled the money back out of her BANK account, and into paypal to hold.

Does she have any recourse here? What should she do about the item? The buyer is in CA and she is in MD.

Any advice would be greatly appreciated.

That same thing happened to me. I sold a guy a nakamichi receiver and he said it was jacked up. The item was fine. I even offered to pay for him to send it to Nakamichi to fix whatever he thought was wrong.

Long story short. They sucked $400 of one of my credit cards. They did not give the guy his money back till I confirmed he sent the unit back. He did send it back. I was so sick with the deal I did not take it out of the box for a month. When I did, I realized he did not pack it right and now the receiver really is damaged. But what could I do then? The bad part is i filed the original claim because paypal sad I should win.

What I learned is, Paypal defends the buyer. The main reason is if your customer pays with a credit card through paypal, they will win overtime. Credit card companies are able to boss paypal around.

So your sister looks like she is stuck. Hopefully she does not get a damaged item back. It does take awhile to resolve.

If they took money out of your sister's account, she can get it back. Tell her to go to the bank and fill out an unauthorized ACH debit form. It is a single sheet saying you did not authorize the withdrawl, which she did not. The bank will forcefully take it back from paypal right away. THIS IS WHY IF YOU USE PAYPAL, ALWAYS PAY WITH A DIRECT BANK TRANSFER! Credit card companies can and do decline chargebacks, the bank will not! Paypal can not do anything about this, they have to play by the same rules as everyone else. What Paypal will do is then freeze the account and tell your sister that she needs to pay it or they will send it to collections. They have their own collections house that may call, if she has the correct phone number on her paypal account, but they have no power and will just threaten. If they call, have her tell them that they do not have permission to call her anymore and they have to stop. In the end, she will be out her paypal account and possibly some aggrevation, but not the money.
 
This has happened to me once, and when I got notice that they were going to pull money out of my bank account. I called the bank immediately and put a halt to all online transactions.

Bingo. They act tough and put on a good show, but it is all smoke and mirrors. They make you think you have no choice and try to intimidate you into giving up the money voluntarily.

First, follow the instructions that Paypal offers and give them as much detail as you can on the claim. They don't always find in favour of the buyer. Make sure you provide the right info and be honest. If the camera kit she/you sold was good then you'll be fine.

If it does get returned to you and the money gets refunded to the buyer then chalk it up to experience and re-list it on Ebay.

In future always remove your bank details so that Paypal cannot take from your account. Also send everything with a tracking number and put the tracking number into the payment detail payment.

I had a buyer claim that a phone I sent was damaged and not as described. I suddenly had a -$648 balance. I responded and within a day the claim was dimissed and I got the balance back.

Don't worry about it. Just respond, be honest and the claim will get sorted.

Are you talking about Paypal?:) Paypal is the scum of the earth company that operates like a bank but doesn't have to follow bank rules. Good luck OP.
 
This kind of crap makes me not want to sell anything large on eBay. Do you think they will ever get the message with these scammers or what sure doesn't seem like it.
 
I myself have never had a problem with paypal.....recently I purchased a supercharger for my Miata from a guy in New Orleans....the packages arrived today but I was not home...will pick up from the post office after work tomorrow.I dont use a CC with paypal though....I have my bank account linked.Never yet had a problem with scams/ripoffs and no problem with paypal either.
 
Paypal allows internet crooks to prevail!!

One time I sold an extremely expensive item. It sold for over $2k. When the buyer received it, he claimed it was defective and wanted a full refund. before I even had the chance to respond to the email, he filed a claim with paypal, and of course paypal froze the funds. Luckily, I did not remove the money yet. Well, in order to fulfill the claim, the buyer must prove that he/she returns the defective goods. In my case, the buyer did just that. he returned something completely different than what I sold him. It was the same manufacturer, but different model. Not only that, the item was trashed really bad and it wasn't during shipping. The buyer has a certain time frame to prove the item was returned or the claim is automatically dismissed. Anyway, I contacted the buyer and told him he is committing a federal offense and that if he pursued this course, I would immediately file with my local authorities. He let it go and the claim was automatically dismissed.

Since then, I video tape EVERY high priced electronic items. Since I started video taping, I have had a few ebayers claim what I sold them was damaged or non functioning and wanted a fulll refund. My standard responce is "sure thing! Simply send the item back and as long as it matches to what I video taped, you will receive a full refund". EVERY ONE OF THESE BOZOS HAD A PROBLEM WITH THAT! They sqawked and complained that what I was doing wasn't right but never once did I ever say I wouldn't give them a full refund. In fact if legit, they would get a full refund. The crooks that try to pull fast one get all upset cause they have to eat what they bought! Let them eat cock!
 
There's a story floating around about some baddddd shit that happened with paypal a few years ago. Some guy was involved with that warehouse with all the NIB games from the 80's and sold I BELIEVE a stargate cocktail? to a guy. It was brand spanking new. He sells it for 2 grand or something like that (might have been a bit less than that, can't remember) to a guy on ebay. The guy requests that he opens the box and checks everything out, then ship it to him. So he opens the box, does some light repair tests the game, etc. then pallets it up and ships it to the guy.

The guy files a paypal claims saying the game is not as described, etc.

The seller notices that the next day the guy bought a working stargate cocktail for about $700 on ebay.

Paypal tells the buyer to return the item for a full refund, the guy ships back the 'used' cocktail and gets a full refund from paypal.

That just happened to me a few weeks ago. All you have to do is call paypal and telling them you shipped it give and give them a tracking number or fax them the receipt or some proof or shipment and youll get your money back.

am I the only one here that would lose money to go pound this guy with a baseball bat?
 
Paypal is an amazing service. The claim process can work in both ways. I have had three or four successful claims against people recently when stuff that should have worked didn't work.

And I have lost out once when a claim was disputed that shouldn't have been disputed. It happens.

Before Paypal I used to have find dollars in cash and send payments to the USA by mail. Or for bigger payments I had to buy an international money order (£20 each time). From the UK.

For small payments for Ebay transactions it's great. For payments in the thousands you should be meeting face to face.

And when it goes wrong because the other party is a fraudster, it's generally the other party that is to blame, not Paypal.

It's my understanding that the "user agreement" has language that authorizes PayPal to pull funds from your bank account.
I use an empty account with no overdraft protection for mine so that they don't pull money from me. I have been fortunate to have had few problems with paypal, but I DON'T trust them as the point was made that they don't have the same rules as a bank.

One issue I did have was a looser ordered a lifecycle exercise bike from me, I was shipping it in 2 containers and had already shipped the handlebars and display. The guy calls me the next day to "cancel" his order then uses his credit card to stop the paypal payment.
One lesson learned, ALWAYS use signature confirmation for items above $250 or PayPal will automatically find against you. The guy cried when he got negative feedback, that was back when sellers meant something on EBAY and could leave negatives.

I would never use paypal for large sums of money for an item I will go pick up either... pay in person or don't buy is my motto.
 
I simply stopped selling most items on Ebay when the new rules including Paypal only went into effect. Anything over $50 I am inclined to sell on message boards or Craigslist.
