Ordering from SuzoHapp. Sales tax?

I had placed an order with SuzoHapp and according to the email receipt, they are charging me sales tax. Is this correct? I'm in California.


I apologize if this is posted in the wrong section.
 
Many companies online are now voluntarily collection sales tax for the states. In my state of Nebraska, you are required to report any online purchases on your tax form so that you pay the tax then. Few people rarely report this liability.
 
Connecticut has been like that for a long time now. The so-called "use tax". You are supposed to report any out of state purchases on your income tax return, and the state of CT will charge you the difference in sales tax. So if you buy something from a state with a 3% sales tax, they want the other 3.35%.

What makes that so infuriating is that it's not the State getting their 6.35%. It's the state wanting to make certain you don't have that money. THAT is why it is a ridiculous tax law which nobody in the state of CT reports. You only have to worry if you purchase large items out of state that require registration with the state/town governments.

Due to this requirement to make sure the populous doesn't have that money in their pockets, CT has required all online businesses to collect CT Sales Tax if the item is being delivered to a CT address and the business has a distributor in state. So because Amazon has a distribution center in the state of CT, any purchases on amazon.com that are fulfilled by Amazon causes me to pay sales tax.
 
Since I'm in California, and they are in Illinois, I should not have to pay sales tax unless they have an office, warehouse or some physical location in California. Am I correct?
 
All but five states have sales tax (local purchases) and use tax (out of state purchases).
The five that do not have use tax are: Alaska, Delaware, Montana, New Hampshire and Oregon.
If your state is not within that short list - you are *supposed to* report out of state purchases and voluntarily pay the taxes (not many purchasers do this).
If a company has a "presence" in a state (e.g. sales office or warehouse or even just one employee) then they are usually supposed to charge sales taxes to customers within that state.

If SuzoHapp does not have a presence in California then they should not be charging a sales tax. Suzohapp lists their locations in Illinois and Nevada. BUT - some states have been trying to place agreements with neighboring states with a presence to collect tax on orders going to their state. Nevada is neighboring state to California - see if they have such an agreement.

This is the thing that pisses me off about Amazon.
At first they had few locations and fought hard to avoid paying sales taxes for out of state sales. Now that Amazon has a presence in nearly every state - they flip-flopped and are now a huge advocate for all other on-line sales companies to also collect and pay sales tax even if there is no presence. Just another example of a huge company trying to screw the competition.

we don't have sales tax here in montana but boy they sure make up for it everywhere else here in many other ways.
