Need your guys opinion??

Ok..so back in February I sold a machine. The guy asked if I could hold on to it for about a month or so while he worked out picking it up or having it shipped. I said "no problem"...

So, a month goes by and I send an email and he says he is still working on getting the machine picked up and ask can I hold on to it for another "few weeks". Again, no big deal to me, so I say "sure:.

Well..long story short..I email him in June and get no response. He provided no phone number for me to call. I need to move the machine so I decide to just mail him a refund and let him know that I couldn't hold on to the machine any longer but thanks anyway. I said in the note I sent with his refund (he paid by check so I sent him a check back), that if he got the refund and still wanted the machine to call me (I included my number). Two weeks go by and I didn't hear anything back. Then, on July 8th, I get the check (well, the envelope it was sent in) returned to me with a "Return to Sender" stamped on it and "Not at this address" written on the envelope.

So, now what do I do? Should I keep holding the machine with no way to reach this guy? Or is it "ok" to relist it and sell it again? Just wondering what you guys think?

Thanks for the input. I haven't had this happen before so thought I would ask "the group"

I'd say you're in the clear. You might keep the envelope to prove that you tried to refund his money, but other than that you've tried everything to contact him.
 
Sell it again. If he contacts you later, ask him for an address and send him a check with the refund. Be sure to send him an email stating that you will do that though, and that he should contact you to get his money back.

Yes..the check was returned in the envelope..

The machine was a MS. Pac cocktail...

It was an ebay sale...the guy didnt want to pay via Paypal so we worked it out and he sent me a personal check..it cleared and everything so I wasnt worried about that

Hope the guy is ok..kind of worried about him...but, oh well..

Haven't decided if I will relist it yet!

well.

also could check ebay and use contact seller/buyer option.
try a lil internet searching as well.. Seems like one hell of
a thing to just "forget" about on his end..
unless he got it super cheap :)

You say the check cleared and then say it was in the envelope. If you cashed it how could it be in the envelope ? I'm confused.

The customer originally paid him by check and that check cleared.So when he refunded the money he wrote one of his checks and sent it down,and that check was returned to him.
 
Have you tried contacting him thru eBay? You never know, he might have updated his contact info there. I remember awhile back you could get a buyers address and phone number thru eBay as well, so long as a transaction exists between both parties.

If you can't contact him through eBay (I'd give it at least two weeks, with messages every other day), I'd say go ahead and re-sell the machine, and set aside the money for his refund. Putting the machine back up on eBay might actually get his attention, if he doesn't answer you otherwise.

The fact that mail to him bounced is interesting - most folks leave a forward with the PO. You might try calling his local post office, if you really want to work at it, and see if they are allowed to tell you anything about why the letter bounced.
 
You guys are all way... way... WAY too nice.

If it were me I'd never have send the refund check... but since you did and it bounced back to you from my point of view the machine is yours to sell.

If I ever have someone ask me to "hold" a game for them, I will make it clear that I'd hold it for X number of weeks after of which the game reverts ownership back to me at which time I'll re-sell it... or at the very least I'd make it clear that the game will be deposited curbside on such and such date (and I'd point out to my friends and family that there will be cab curbside on said date).

Feb to July is a bit much...
 
I hate to say it, but if he sent you the money, and it cleared / became your money, and you agreed to postpone the pickup date, (for any amount of time) that game is his... Especially if there is an eBay auction / contract with it.

Just keep trying to get ahold of him, it's all you can do. You can file for "abandoned property" with your local authorities and then they will try to contact him, and if they can't find him, it's yours again.

I think you could re-sell the machine now. The only thing he could do is take you to small claims court. If you have emails, returned checks and ebay messages saying you were diligent in trying to contact him after the agreed amount of hold time, I think you'd be in the clear.
