KLOV images for use of eBay sales is ok!?

I ran across this local sale on eBay.

Not knowing anything about this game I jumped over to our lovely KLOV page to take a looksie. This REALLY resembles the eBay picture is don't you think?

So I notified eBay because it's BS they used the KLOV picture and it's BS that this isn't the ACTUAL cabinet they are selling.

Not that I should expect any action from eBay but they respond with:

What if it is his machine that is pictured on KLOV? (not likely but it could happen)

Could be? But doubtful. It's one thing to use KLOV pics on CL and eBay as a REFERENCE to show the machine because you don;t have a camera or maybe you're at work when you post it. But not stating that the picture is for reference only and not of actual machine is another issue. It's very misleading.
 
Buy the machine... then dispute the charges that the item is not the item that was pictured in the auction. See if you can get your money back. lol
 
Read it more carefully. It's not that ebay is saying it's okay, they're saying that they'll only take action if the owner/operator/whatever of KLOV submits the complaint. They will only take action if the copyright holder asserts their rights to the material, the same policy youtube has had with tv show clips, and many other sites have. Had it been submitted under wrong/misleading photo/description or whatever that other complaint category is they might have responded differently, but due to it going in as image/text theft, this is how they responded.
 
All we need is for the site to have a policy page that states images cannot be used for auctions or sale purposes. Then when this comes up just refer eBay to the images and to the policy page.
 
They should pull the auction anyway because of a completely retarded and unreadable description layout.....
 
yea i can not understand why people just dont go out and buy a camara they are cheap and post pics of what they are selling,and the cost of the game they are trying to sell , i would want real pic's, i think it is very misleading to post pics from KLOV and not the real item.
 
I cannot stand auctions that use funky background that makes reading the text almost impossible. Besides a picture not of that machine, no description (did it even state that it works?) I couldnt see

edit: ok, it states complete and well kept
