A guy dropped really nice R-Type to me last spring to get it going. Had some major fold over and kept cutting out. I recapped the monitor and rebuilt the power supply. I have not been paid yet nor has the game been picked up. I have contacted him 3 times to get it.

How long would you wait till you consider it yours???

Can you or have you tried to mail him? If you can, mail him an invoice and make a copy for yourself.

Contacting him 3 times is a lot but I would still try another way before calling it yours.

I would contact him one more time and give him x number of days (me, Id say 7) to remove the game. as long as its already been there you could keep for storage/abandoned, but Id try one more time with a set date

Depends on the laws in your area. According to the laws in TX, I have to wait TWO YEARS - AFTER posting a public notice in the paper, and sending a certified letter before I'm allowed to declare it "abandoned" and now my property. If I wait a year, THEN post the notice, I have to wait another two years. If it had been a car, I'd have been allowed to do a lien on it within 30 days. Same if I was a landlord. But because I'm not an actual business (tax ID # and everything), it fell under the "personal property abandonment" rules.

I found this out when I sold a game (and it was paid for) over the internet, then waiting 23 months for the buyer to finally get shipping arranged...
