Ebay? WTF!?!

I mean its like he's trying to pull the Jedi Mind trick on me.....

It sounds like he really wants $800 for it and is trying to get you to double your bid. People like this are a joke, I'd be willing to bet he had it on Craigslist for some outrageous amount and decided to cash in on eBay. I really hope you get something out of this guy though.
 
I just researched it a bit and it looks like you can file a "non performing seller" alert, its like a "non paying bidder" and it goes against him. I think there are grounds to sue at least for something but that's a whole mess to deal with. I'd file the NPS, slap him with neg feedback and go with 1 star on everything just to knock him down a bit. I'd send the payment via PayPal just to have him refund it too just to get them involved. It just depends on how far you want to take this, its obvious you aren't going to get the game now so just go as medieval on his ass as you can.

This all I what I know about the eBay NPS claims process. Andwith all the cold feat sellers on Flake-Bay, I'd file a NPS claim anyway. It can't hurt; however, it probably won't help either. :mad:/:(

Tell him if he sold it for $800, that is was YOUR machine he sold and now owes you $400.

He's local and you've got lots of opportunities to be a really PITA here. Send him an email telling him that you will pay him a 10% commission ($40) for selling your machine for you and that you expect your $320 sales proceeds promptly. If he blows you off, go ahead and sue him for $400 plus court costs. When he doesn't show take your judgement and immediately file a garnishment against his wages.

Follow this shit through and don't let him get away with this sort of douchebaggery. No reserve means no reserve. I sold a couple games on ebay once, they each went for $75. I could have parted them and gotten more but a deal is a deal and once you list something for auction you are agreeing to abide by the terms.
 
If you know any lawyers have them draft a "letter of demand" and have it delivered to him. Let him know that he either sells it to you for $400, gives your $400 in profit or you will take him to court where you will ask for the game or the profit AND any and all legal fees and court costs. Once the douchenozzle gets a letter from an attorney he will shite his pants and make it right....
 
Guys, again, this is all hard ball stuff and isn't going to work. It will only piss off the seller who obviously doesn't intend to sell it. And I hate to say it fellas, but a seller can refuse on a sale by a variety of means. Last week I sold a console, and then promptly dropped it on the floor trying to package it up. I had no choice buy to cancel the transaction and withdraw the listing. I'm sure the buyer wasn't happy to see the item he won and paid for suddenly be yanked from under him, but from ebay's standpoint, all the seller has to do is claim that something happened to the product, stolen, etc., and he's off the hook as far as being obligated to deliver the item.

Now, that being said, if you want to be ballsy, offer him the 800 he wants, show up to his doorstep, give him 400 and just stare at him.

The advantage here are all the messages sent saying he decided not to sell and got a better offer. You can't say all that and then turn around claiming it was damaged/stolen/lost once eBay gets involved. I wouldn't count on getting anything but I'd slam him the worst I could.

The eBay seller can still preform the contract and sell the PAC to the winning bidder for $400.00; however, after the fact, the seller has shown that he is not serious about selling the PAC to you for $400.00 because he believes that he can sell his eBay item for $800 to someone else.

So, IMHO, clearly you are in the right.

It's not like he does not have the PAC anymore.

Oh I'm sure he still has it. No one in their right mind would pay $800 for it. $400 was a generous bid in my book.

Wow, this is pure and utter bullshit. You've done absolutely everything that could be expected as a buyer and done all you can possibly do to try to still resolve it in a happy way for both parties and he's made it very clear he wants to play hardball. Good luck in whatever next step you choose, have no mercy with the claim-filing, and may Namco have mercy on his soul.

IMHO, cabs. have sold for much less both on and off eBay. So, the seller should be happy that he's got someone ready and willing to pay $400.00 for his game.

Unfortunately, it takes multiple offenses before they'll even suspend his account.
 
Basically I take the same approach with ebay that I do with craigslist..there are so many tools you have to deal with that both are always a last resort.

Ebay sucks ass and has for the last 8-9 years..that is all.

That's crazy talk, that thing is "vintage" and a "classic", its worth $1899 as is and $2999 restored, you were trying to rip him off!!!!

Na it wasn't a grail, or a great price, but I'm a fan of Midway cocktail tables, and enjoy restoring them. I figured for $400 and an hour drive I'd throw my hat in ring for the bidding. I was kind of excited when I won it.....
I'm wondering how long it'll take it to show up on CL??!? I'm guessing sometime before Christmas.....

That's what sucks, you get assed out on a deal and find it on Craigslist shortly after. I've missed out on a few things that were good deals that I really wanted for myself. I see them posted again for way more money and it pisses me off. I saw one guy repost a bike using the other guys pictures while the original ad was still up!
Buying games can be a pain, I saw a Star Wars upright in a price range I could afford and it had just been posted. I sent the seller a message right away asking them to call me and never got a reply.... I was bummed. After I joined here I found out it was a member, I wish I would have found this place sooner because it might have given me an edge on getting it.
