Did the work themselves? I created the composition for that sticker. It didn't exist before I made it. It's fictional! :)

Did you notice the rest of his items for sale? Almost all dk stuff and a bread maker instruction manual? Odd
 
yes it's wrong for stealing your design. I'd basically try and scare the seller into stopping selling the item. More or less explain it's your art work that you have an agreement for another person to sell and that he is infringing on your rights be reproducing your original art design. My guess is there isn't enough money involved to go after the guy if he says piss off but the threat may be enough to stop him.

I haven't made a single cent off of the design and Rich is basically covering his printing expense. So, it's not about money at all. Just principal. It's just dumb.
 
Can you prove you made it? If so send that info to ebay and im sure they will pull it no problem.

BTW I believe you made it, but who knows if ebay will is my point.
 
I think the reason I asked "What's the rule here" is because nobody involved owns the rights to Donkey Kong 3. It's a fan piece. It's for fun. So, I don't see how anyone can contact ebay as no one involved owns the IP. So, it's just poor etiquette I guess.
 
You dont have to contact Ebay. You could contact the seller, explain to him that you designed these and kindly ask them to stop selling them. The worst he could do is tell you no.
 
Hey John, just send him an e-mail and requests he takes them down. Tell him your the creator of this piece of art and you will be reporting it to e-bay if he doesn't remove it himself.

This is BS because this is your original work inspired by DK and DK Jr. instructions. This isn't as simple as recreating Nintendo's original art. This is theft of your original art! Just not 100% sure how this would play out seeing it's created/inspired from Nintendo's original art. But, it's still not Nintendo's design. Just a fine / confusing line.

Unfortunately, this is something that happens regularly even by members here. We call it a hobby, but to others they only see $$$ and will do anything for it.

You feel burned because it is your artwork. It isn't any different then other members here using the artwork at the Arcade Art Library to sell a Multicade or any of the other billion ways someone tries to make a buck.

It sucks. After you report them, someone else will take that opportunity to do the same thing. Take a deep breath, move on, and try not to let it bother you. Whatever you do don't let it take away from you wanting to create more things, because I guarantee more of your artwork will be sold in the future.
 
I'd just contact the seller and let them know what the deal is nicely and ask them to stop selling something you created that was never intended to be sold on ebay.

You don't own rights to DK3 so i doubt ebay will do much to stop it as there is an IP form you have to fill out saying you own it, or at least that is what we had to do.

If ebay doesn't stop the seller then you dont have much else you can do about it so i'd just try to be nice and maybe the seller didn't think it through very well before he did it and realize someone would get pissed off...maybe they will pull it?
 
I'd also make sure he is not just reselling a legit piece that was purchased through the right channels.

Otherwise, if it is as you say, I agree. It's your hard work being exploited, not just someone one-offing it for personal use. This is why people use to watermark their artwork like crazy on the Internet ten years ago.

I agree I don't think this is very cool at all and you may be able to take legal action.

I have to let you know something that you may not like though. If he changes just one or two thing then it changes everything. Many companies do this to get out of copyright infrigments. I know there is no copyrights yet but I don't think it is that expensive or hard to do. Maybee a registered mark? I have seen some games that are almost exactaly like Donkey Kong and they are named something like monkey kong. If you have your picture taken at a professional studio then you can't copy them at Wal-Mart (legal reasons). I am not shure about all the legal issues with this but if it were me....I B lookin in to them.

I would first ask him to remove the post. Then I would tell him to remove the post. Then I would threaten Attorney action.

If you do a search for Dos games and "pac man" you will come up with somethings like gobbler, pac mania, etc. that are just like the pac man game but not exact.
