The situation, i had a guy buy my outrunners and sub-roc at my dad's shop. He paid me in cash but had no way to get them home A couple weeks go by and he calls and says he's going to get them that night, then calls and says he can't make it. A couple more weeks go by, i call him and leave a message asking if he can pick them up over the weekend. 3 more weeks have passed and i haven't heard a word. As we are approaching a couple months, i'm getting kinda tired of waiting on him and i havn't heard from him. Heck i don't even know his name. What would you guys do, i would kinda like them gone, but he could be dead for all i know? If you paid someone in full, wouldn't you guys try and pick them up within say at least a week? Almost 2 months has come and gone. Thoughts

I could come pick them up since they're already paid for and everything. :p

But seriously, make every attempt to contact him and if you can't get him then sell them again.

since tey are paid in full ill come and take em off you hands lol my trucks empty and i just made enough room in the shop for a few more games

but to be serious id leave the guy one more message saying he has one week to pick them up(or at least contact you) otherwise they will be sold to the next buyer and if he says he will pick them up at this day and time tell him that any time over that set period he will have to pay storage fee

at this point they guy really starts oweing you storage fees

edit
ghostnuke how the heck would you fit thoes in your game room the old lady would really be happy obout that one

Crazy isn't it? My buddy had a guy pay him 3 grand for a printing press then disappear.
He sold it to make space, then ended up being stuck with it for another year, afraid to resell it and afraid to just spend the guys money.

He finally relisted and sold it and never heard the buyer again. This was like 4 years ago.

i had a guy give me a $200 deposit on a machine, then disappear. i resold it about a month after last hearing from him. Never heard from him again.

Not necessarily. I buy games from people here all the time... then start worrying about how I'm going to get them. Right Jow? Herbertsmart? AvidGeek?:eek:

I'd love to have that Outrunners. No way I could haul that beast though.

Call the guy, leave a message if you have to. I'd give a 30 day notice. If you dont hear from him after that, its legally considered abandoned property and then you can resell it without any reprocussions.

Call the guy, and leave a message on his machine. Your out is that it's in your pop's place.

So just say "Man, my dad is pressuring me to get these out of here, he needs them gone in the next week, or he's going to haul them to the dump"

If the guy doesn't pick them up in a week, sell them again. No refunds. 2 months is plenty of time.

The guy, ultimately, is taking advantage of your good nature... so unfortunately you're going to have to be a little more of an ass about it. Usually, you can be a nice guy and everything's cool, but when people start taking advantage of you, you have to show your ass a little bit.

Just my opinion! Good luck.

The only reason i havn't got upset is because they are like you mentioned at my dad's shop, and i've been paid in full. I just don't want to be responcible for storing them for too much longer if a fire comes, theft, tornado, etc i would feel like bad for the guy. I know if it wasn't for my uncle having a liftgate truck both (yes i have 2 double drivers) set of outrunners would have never made it home. Those are a beast. On a side note i did have all 4 linked at one point. Was really cool to be able to play with my kids all at the same time. Just took up too much room.

If you have his contact information call him and tell him that starting next week, you will be charging him a $50 a week storage fee. If he doesn't pick it up in 10 weeks, it's yours again.

The general rule at repair shops, et.al. is; It's your property. After X days, storage is Y$/day. When the storage fees equal the unit cost, the unit is sold to pay for the storage fees.

For example; Assume he paid $300. That money is yours to keep. Storage after 30 days is $10/day. After 6 weeks (total) he owes you $140, the game being held as collateral (and accruing more storage fees) until he pays. If you're feeling generous, he can get $160 in refund and you keep the game. After 60 days (30 free, 30 paid storage), you can sell the game to whomever (yourself included) for whatever you like to cover the debt.

Nothing says you can't sell it to yourself or your brother for $0. But if you sell it to someone you know for less than the storage fees due, don't be dumb and try and hit the buyer up for the deficiency. If they can prove you had an interest in the sale, they can come after you for the rest by claiming you artificially suppressed the price for personal gain. Be aware that in some states if you ultimately sell the game for more than the storage fee, you now owe the buyer the actual sale price less storage fees.

You've been more the generous and gracious up to this point. I'd make one last phone call giving a "Pick up this weekend or you forfeit" and be done with it.
If you ask me it's completely unacceptable and rude for a guy to expect you to store his games until he's ready to pick them up. Respect goes both ways and right now it's a one way street.

Queue up modessitt's story about holding a game for 3+ years after a guy paid...

Just drop him a note and/or call (if you call make sure you keep track of date & time). Tell him he has X days to retrieve the games, where X is how generous you feel. If you have access to some means of delivering them, include that you will deliver up to ZZ miles for $YY with $1 per mile over that (common values for ZZ = 50 and YY = $75).

If you continue to keep silent, the word "Welcome" will soon become visible for all to see.

If it was prearranged with you to hold them this long, or he at least kept in contact with you about what was going on, it would be a different story. The fact that it's going on 2 months, is not your responsability. To be nice, call him, give him the bottom line. If he can't meet that, keep his money aside and sell the games to another. Return his money just so no flac tries to come your way.

Two fellow KLOVers have been more than generous with me about a game staying with them for a little bit(2-4 weeks), but it was something I was upfront about, and I've stayed in communication with them about it. That is the buyer's responsability, buyer wants, buyer needs to follow through. I'm currently holding a couple of games & parts for other great fellow KLOVers, which I volunteered to do, and all of us have talked to each other to keep each of us in the loop of what's going on. It's a two way street, you only have to offer for so long IMO, if you're not getting anything in return. It could be worse, you could've been really nice to the guy and just held the games without money, and then him pulling this crap. At least you're still ahead right now :D

That reminds me, I need to go send off a few PMs.
