Um...Red Baron? He was technically a "bad guy" during the war, and aren't you supposed to be him in the game?

Street Fighter II: Champion Edition (and most, if not all, SF versions after that); you could play as any of the "boss" characters, including M. Bison.
 
Technically, if Mario us the good guy, then you play the bad guy in Donkey Kong Junior, as you are trying to break your dad out of prison.

And if prisoners are "bad guys" then games like Bagman would be fitting.

Then there's a game like Elevator Action where you are a spy breaking into a building in order to steal secrets, and are shooting the guards...

You could technically be the villain in Paperboy by throwing papers through people's windows,more so if they are subscribers.

Thief and Shark Attack let you be the "bad" guy and do evil.

Also Outfoxies, since all the characters are assassins trying to kill each other for money.
