Anyone had this happen through Ebay?

I listed a game for sale back in early June on Ebay and got a winning bidder. After the auctions end I noticed that the winner was 9-10 hrs away in a different state. In my description I specifically noted that the machine was pickup only. I'm thinking to myself,let me get ahold of these guy to ask him if he realised that he bid on a pickup item with no shipping. I message the a few times of the course of a week,no answer. Finally I find a phone number and I call it getting the buyer on the line. He tells me he's going to pick the game up the following weekend and he would call when he was ready to depart. Fast forward to that weekend,no phone call,I call all weekend ,no answer. He calls me the following week promising again to pick up the next weekend and even paid for the game via Paypal,guess what? No phone call. I sent him a few messages through Ebay,even called a few times no answer. Fast forward to today (48 days later) and I still have'nt heard from the guy. In my situation would you as the buyer say that this guy officially forfeits from the sale leaving you to keep the game and the money? Or would you send him a Paypal refund and leave it at that? How does one know what their options are in a predicament like this one?
 
This hasn't happened to me before, but it seems to me that it's either his or you refund the money (perhaps minus any fees you've incurred)...I guess this would get touchy if you've missed out on other sales.
 
Message him and tell him that there is going to be a storage fee incurred if not picked up..
if you do a refund, refund minus listing fees.
 
I'd send him a few messages...like one email, one voice mail, one text message that if he does not pick the game up by xx/xx date, your going to refund his money (minus any fees) and put the game back up for sale.
 
I would say you should refund him and resell it if he doesn't get it soon, but it would get nasty fast if you did so without warning him. I know it's already been a long time, but I would give him a deadline, like... you need to get it by this weekend, or else type of thing.

Worst ebay experience I had... I won a cabinet that was supposedly a couple of hours away from the listing, and spoke to the seller about it being a couple of hours away and they're like oh, that's fine. But then they message me the day after I win and tell me that it's actually five states further away and more like seven hours each way. Needless to say, I got a refund and it was all okay (didn't really like the game that much anyway), but it was pretty bizarre.
 
depending on your state law, you didn't have to refund money and after x amount of time the cab would have been considered abandoned by the buyer & it would have been yours also.

You know,I was speaking with someone else about this outside of KLOV and they mentioned the same thing you just did.
 
i would NEVER let anyone pay me through paypal for a ebay item if it was NOT being shipped. Ive been selling on ebay since ebay started and have had every known scam pulled or tried to be pulled on me. By ebay and paypals rules if you cannot prove a item has been shipped and DELIVERED (being shipped doesnt mean crap to them) the buyer can and will get all his $$ back. there is no room to argue with them....ive tried and have never won. everything is done with tracking and thats paypals only way to prove the buyer got the item. if this buyer (and im not saying he would...but who knows) paid you with paypal then picked the game up then puts a claim into paypal as never getting the item you will loose your item and your $$ ! just my 2 cents on the matter.
 
You refunded so youre done. Dont worry about it.

IF you kept the money, id send him a certified letter saying he had x amount of days to pickup the game otherwise a $30 a day storage fee would begin. IF after the time that that amount became the amount he paid for the game, youd be done you own it.


But laws vary state to state. SOme states you would have to store this for a few years before you became the lawful owner again.


If i sold a game and it never got picked up id keep it in the collection for a couple years at least before trying to reselling it, or maybe just keep it, just in case.

Almost the exact same thing happened to me, although it was not through E-bay. The buyer wanted the game badly and probably could not afford it. He offered to make payments on the game. As soon as I confirmed that the last payment was sent, he seemed to disappear. I have tried e-mailing him several times and have gotten only vague responses. Even after telling him that he needed to give me a date that he planned to pick up the item or I would re-sell it, he still responded the same way.
