Am I being a dick, Ebay question, opinions wanted

just a heads up. I had to call eBay about a problem with a buyer about 2 months ago who refused to pay for shipping and insisted on picking it up a month later. Anyway I fought for nearly 2 hours with them on phone about it. Everyone spoke engrish and the language barrier was a killer. If you go this route clear the calandar for the day
 
So far, I am just wanting to calm down and gather my thoughts. I am upset, and do think the guy is being unfair for lack of a better word. But I want to approach it the right way to make sure this doesn't happen to someone else. So heres what I think my options are.

1. Leave (really) negative feedback: can be done right away, but would be better after I have tried to reason with Mr. Sunshine first.

2. Open a Claim with the resolution center if 1 fails miserably.

3. Report the seller for Seller Nonperformance if you guys can verify its a real option.

4. Call the ebay support line if I don't get any satisfaction from 1-3

So I guess my question is should I email the guy first with a very civil message and follow up with the feedback or should I try to resolve it through ebay before I leave the feedback.

I am guessing that I won't have leg to stand on since the guy already refunded my money through paypal, but even that annoys me. Its like he was saying can I please be released from my obligation and then said take your money back, I'm keeping it, before I even got to respond. I was away from the computer for a couple days, so I don't know how long he waited, but the fact he did it without the reply didn't really give me a reason to be sympathetic.

People like this are ruining (ruined?) ebay.

I would at least fill that form out and see what happens. Hopefully he gets canned. It's up to you of course.

Normally if there is an issue, I always contact the seller first. But in your case, he was being a total jerk.

Follow through on your return policy.

Respond to buyers' questions promptly.

Be helpful, friendly, and professional throughout a transaction.

Make sure the item is delivered to the buyer as described in the listing.

Don't futz around any longer...open a dispute, contact ebay and pin this a**hole in a corner and make him cough it up. That, or at least get his ass banned from ebay.

What he did was pretty f'n low...

I think I will be able to get something done about this guy, but I don't think I will ever get the item. I think now it just comes down to taking an issue with what the guy did and making his actions hurt just a bit. So to answer the above question, I may not be going full on war with the guy, and I will be fine without the sign. But I do think the guy will know better next time, before I get done with him. I'll try to keep everyone updated as things develop.

Make him rue the day he decided to shit on a binding contract to sell something - I would be a severe pain in the ass to this guy - who cares about the sign at this point - it's all about teaching this dumb prick a fundamental lesson in auctions and ethics!

IMO

Backing out of an auction needs to have its consequences otherwise they just keep doing it.
Report this seller to ebay and make sure that you inconvenience him any way you can
in a professional manner.

The seller wants you to mutually agree to cancel so that they dont have to pay the ebay fees, but they need to so that they wont make that mistake again.
Afterward leave the appropriate negative feedback and warn ebay that the seller may try to retaliate by leaving you negative feedback. Remind Ebay that you did indeed pay already and just want to hold the seller to your binding contract.

After the name calling he should be spared nothing.

You wont get your item but you will be protecting other buyers/bidders from this

part I keep thinking of is that it's a neon sign, and going through fire hoops like the Miami Dolphin for this just to have him pack it shitty or intentionally break it and be like "uppz sorry, broken in transit" is probably a feasible option this cockfuck will take.

if you do go through with this (which I don't see you in the wrong, it's an item you won fairly and there was no reserve on it so fuck him) make sure somehow that there's insurance placed on it or else.

I say call him a cocksucker, leave uber negative feedback, "fuck you dude keep your sign" and see if ebay can shitcan him.

I liked the one where you run up the price on one of his other auctions and then when going to pay just tell him "oh, I don't like the price, I'm not paying it" LOL
 
It's pretty cut and dried in my opinion... If he puts it on ebay, with no reserve, and it doesen't go for what he wants, them's the breaks... it IS a contract.

Be civil about it though... just do everything in your power to make this guy feel like crap. report it to ebay, get him banned, leave bad feedback. It's not right I tell ya... that is a kickass sign too... I'd be hella pissed

I had some issues a few months ago with something i bought on ebay. It was defective and i messaged the seller trying to get a response. I waited 3 days i didnt hear back so i contacted ebay. I opened up a claim and was encouraged to leave negative feedback. I told her i didnt want to go that route cause I didnt want to recieve negative feedback in return. Dont remember exactly what she said but I believe once you leave negative feedback for the seller they cannot leave you negative feedback or something along those lines. Just a little heads up

Yes, as I stated in my earlier post. E-Bay is going to do NOTHING to the seller. You can send messages back and fourth on why he needs to abide by the contract. You can file a complaint with E-Bay. You can do all that crap and when the dust settles he still has the sign w/maybe a warning from E-Bay.. Just leave him negative feedback and move on with your life. I think you created enough havok that the guy learned his lesson. As I also stated before the seller can NOT leave bad feedback to the buyer NO MATTER WHAT.
 
I still like the idea of bidding one of his other items sky-high and then sending him an email telling him you've decided to "cancel the transaction" and won't be paying.
 
Dont go sky high with the price then he will know its BS and just cancel his auction. Just try to snipe it or give just what it takes to win the auction and then back out.

its better to just take care of this through legit ways, and leave any shinnanigans to others followers in this thread.

i dont think a new account can just place a 20 grand bid anyways, ebay is stupid but at one time along time ago they werent so stupid, and they still run with some of those setting and rules

Sorry to hear about this... real douchebag move.

I recently sold a Gameboy Advanced for my 12 year old. He was excited because he saw several similar bundles sell for $80-100. I told him that he is entering a contract and will have to sell it for whatever it went for, even if it was $0.99. Which is where it sat for 6 1/2 days, then sold for $65. He was not happy, but understood that he had to sell it...

Leave the prick bad feedback and move on...
