Hello all,
I thought I would ask the group a simple question, "Am I being an unreasonable dick with regards to the following situation."

First, the auction: What is this item worth for those who have bought them before.

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItemVersion&view=all&item=180511097713&tid=0

Second, here is the message I recieved after the auction closed and I sent the payment via paypal via a transaction cancelation request:

This case has been opened by the seller with the following reason: Other.
Additional information provided by the seller: I am selling this item for my son. It did not go high enough for him to part with it, so i refunded
your money and hope that this does not cause any inconvenience to you. This item is rare and he would
rather keep it than to settle for $142.50 for it.

Thanks you,
(name removed to protect me with ebay)

Third, I responded:

Regrettably, I would have to decline your request to cancel this transaction. I routinely see these
go for 150-200 and while the price is lower than usual, it is not greatly lower than the norm. I'm
not sure what price your son was hoping to get with this item, but the BIN prices of 300 that some
list is not a realistic value. In the future, I would recommend using a reserve, or BIN to ensure
an acceptable price. Please resend the invoice so that I may pay for the item again. Thank you.

And Fourth and Fifth, I got these two responses:

Regrettably you have to decline the request to cancel....in the future i should add a reserve to my auctions.....resend the invoice so you can pay for the item????????? What part of my son decided not to sell the item didnt you understand???? It is a bull shit move on your part to decline the cancellation request. He is not selling the item....and yet you could care less that i will still have to eat auction fees for this item. We dont care to have an educational speech from you about what these signs go for....the bidding was not high enough for him....for whatever reason it has nothing to do with what other signs are going for.....and he doesnt want to sell it. I have been doing business on Ebay way longer than you have and do not need a lesson from you. I would never decline another ebayers request to decline. You are a real Tool!!!!

(Fifth) By the way Tool...your money has already been refunded......jerkoff!!!

Am I being an unreasonable asshole to hold this guy to selling just because he is unhappy with the results. I'm asking you guys before I call ebay or respond to this fine ebay seller.

Thanks in advance guys, regardless of your opinion.

Report this Degenerate!!!!!!

What was it, link didn't work.

He should have sold you it, regardless of what the price was. What would happen if you got a real auction, someguy bids on it. Oh, sorry, not high enough, not selling it to you now. These people piss me off.

You should reply to him and ask if he would let you cancel if you won it for $500 and then decided that was too much.

HAHAHHAHAHAAH!!!!! funny!

Maybe you really should ask him though from what he says here:

I would never decline another ebayers request to decline. You are a real Tool!!!!

My response:

You are attempting to finagle out of a binding contract. Please give me an excuse to sue your ass.

Hey you think thats bad? How about me and my girlfriend bought a HOUSE, Paid $300 for the inspection...another $300 for the loan application fees...went through all the BS of getting the loan...then when the appraiser went to do the appraisal...the jerks wouldn't let him in. Finally the realtor got hold of them and their reason...."We decided we didn't want to sell it". WTF!?!? Even with a legal binding contract...we got screwed because if we took them to court the most we'd gotten was our $600 and the lawyer and courts fees would've been more of a pain than anything.

So in a nutshell...I understand what you're going through and sympathize with you greatly...and i say report him for the hell of it.

You're not being a dick, but there's no way he's going to let it go for the final auction price. He's obligated to sell to you, and he's likely feeding you BS because it ended for less than what he had expected, but there's nothing you can do to force him to sell.

I routinely put stuff on eBay and it goes for way less than what I had hoped for - oh well, then that's what it's worth!

Just leave a horrible, horrible feedback rating - it's all you can do.

He's a maroon. Not your fault if he "has been using eBay longer than you" and doesn't know how to protect himself from a selling price lower than he would accept.

He HAS to accept it.

Is it acceptable to eBay that the seller decides not to sell because he admits it didn't bring a high enough price?

He's a JACKASS and you should pursue it with eBay... although I am certain you'll be disappointed with their response. They always seem to pick the least ethical or logical perspective.

The only thing you can do now is give him negative feedback. There is nothing you can do at this point. He cant leave you bad feedback becuase the stupid F%^$%^ IDIOTS at E-Bay decided sellers should not be allowed to leave negative feedback for buyers.

Let me be the voice of reason here. We are talking about a neon sign here, the last thing you want is a pissed off seller sending you a neon sign. Once you receive it in pieces, there would be nothing but more problems. I would send him a polite, thoughtful email. Explain how eBay forms a binding contract. Explain how if the shoe were on the other foot, if you bought it for more than they expected and you tried to back out because you bid too much, how would they feel? Ask them to honor their word and send it to you at the winning bid. As hard as this will be, leave them a graciuos out. Tell them you undersatand how their son might be dissapointed and might not have understood how an auction works (yeah a crock I know) and that you'll reluctantly agree if they are adamant, but that they should know better for next time...

The seller has a feedback rating of 672 so he knows what he is doing. He is trying to screw you out of your win and will probably sell it again. I'd let it go as my guess is that it will arrive broken if you were to actually get him to ship it. Watch for his future auctions and let us know so we can all bid up his auctions and then ask that he cancel the auction like he did with yours.

Another thought... create a new ebay account and watch for this douchebag to put it up for sale again. Bid that shit up as high as you can go and then when you win it, post his reply to you back to him but in reverse.

He does have a couple other things up for auction...
