A lot of Marquee's for Sale

Maybe the deadline was based on him needing some quick cash to get out of town. However, I'd suggest everyone NOT just to conclusions yet. However, NOS is NOS... Unless he was thinking "No, it's Old Shit"...

Conclusions?

I asked if they were true New Old Stock with the paper still on them. Was told yes. Was untrue.

Was told he didn't get my PM yet he showed up on the Who's Online reading PMs during that whole time. Was untrue.

Was told numerous times today that I am the only one complaining. This is untrue.

His note in the package states "never used" when they are clearly. This is untrue.

He refused to do anything for me and claimed I was trying to rip HIM off.

He's been off and online all day today as he kept replying to my claim, yet hasn't come here whatsoever to stand up for himself.

I give as much of a benefit of the doubt as anyone, but this whole thing reeks and reeks badly. Clear misrepresentation.
 
I just escalated my dispute to a claim. In a way I feel shitty for not allowing him to asnwer but at the same time he wripped me and a few other guys so I say fack it

Here's paypal's answer. Freakin Moron's:

He's had enough time to address TexasHotShot's paypal dispute. The silence speaks volumes... you don't "run and hide" from people you've dealt with in good faith.

True... I'm starting to think he was possibly screwed or possibly selling these for someone else. Maybe they never even touched his hands and the owner shipped them direct... Either way, it's his name that is getting screwed.
 
He hand wrote a note to me in the box I got... they touched his hands. Remember the hand written "never used" note I've mentioned.

He only replied to my PayPal claims... he still has never come here...
 
That's what it appears to me. altough I had the same issue before with n ebayer as he send me the wrong marquee and I ended up sorting it out before escalating it to a claim.'The only difference is that the seller was willing to work with me. This guy doesn't seem to give two shits.

Here's something he sent me a while back when I was inquiring about the marquees. You think it might hold up against him?

"I won't ship the marquee's until the end of next week, just to give you a heads up. When i give you the dimensions, if they will not work for you then i'll refund your money or we'll work something out...Thanks for your business".

Dimensions do not work. They are too long plus t5ey are not new as promissed. Case closed IMO.
 
This is why when I buy stuff I always use a CC. PayPal can determine their stupid claim any way they want, the CC company will still refund me afterwards.

I got a reply from him via PP:

"I have received no messages from you. The items are new old stock, never been used, i'm not responsible for shipping damages or storage damages. The marquees where in good condition when they left my hands, what you do from that point on isn't my problem. I looked at the pictures and they weren't that damaged when they left here... I sure hope that you are not trying to cheat me out of money.."

WTF? I'm trying to cheat him? He claims I haven't tried to contact him, yet I have a read receipt from here saying he read my IM. Well, looks like he knows what is up. I'm going to do the dispute then have my CC fight it. Maybe PP will wake up on this.

For the people who used paypal, has anyone tried calling him. His name and address should be on your PP statement.
His name is Eric and he lives in Caldwell, Idaho. Look him up! I want a conclusion to this crap.

Well for me it was 2 marquees at $30 total so not really worth it to get personal (ie calling him). I'm good with the PP then the CC dispute. I have a perfect PP and ebay record so hopefully that will be taken into account. Not sure it will, but hey, what else can I do.

As far as small claims court, I'm not sure how that works across state lines, but if you need a witness, I can show up!

I'm going to chalk this up to me paying $30 for two used marquees!

Maybe he's telling the truth. Perhaps in shipping an evil army of marquee brackets and tape ATTACKED our marquees and trimmed many of them town with secret plexi cutters.

See, folks? He knows what NOS means... he says "never used".

He ripped us.

I may try calling him on my next in-shop day of Thursday.
 
Well now Jesus H Christy Almighty...

I'll give the guy a call and see if I can make voice contact with him. I will explain to him that he has managed to piss off just about everyone he sold the marquees to and see what he says.

I am a LITTLE worried because it DOES sound like he was collecting some dough to skip town and if he DID do that, he skipped town with my brand new degaussing coil...but I have to have faith...the guy seemed like he was pretty much on the up n up...nice guy. Hell, my wife and I even made preliminary plans to have dinner with him and his wife (who I have yet to meet).

Last I heard from the guy was a PM to me saying "Hey bro, I am in California and will be meeting my arcade guy, do you need anything?" which I responded that I needed a Sanyo 20EZ. That was last contact, which was about a week or more ago.

It is hard to dispute the photo evidence from MULTIPLE sources here... if those marquees are what was sold, they are clearly NOT New Old Stock.

Let me try to get ahold of the guy...

EDIT: Did anyone who purchased marquees from Foxen GET NOS marquees? Anyone who bought some HAPPY with their purchase?
 
I picked up 9 marquees... only 2 are NOS... sadly they are the most worthless of the bunch (VS Golf and Motorace USA). Castlevania is in 9.5+ condition.

The other 6 are used trash as seen in my photos, especially the Pac-Man one, complete with spraypaint overspray.
