A lot of Marquee's for Sale

What is interesting is that in his original post, he contradicts himself

I just recently acquired a lot of NOS Marquee's, some never used and still has plastic coating.

So, by definition NOS is not used.. it is new (original) old stock products - not reproductions, etc...

by him stating that they are NOS and some never used, he clearly is stating that he doesnt know what NOS means. He also is admitting that some are used.

i am glad that you guys filed a complaint, as he needs to learn a bit more about the condition of the products he is selling.
Hmm... I never thought of it that way, but wouldn't you verify the meaning of a word BEFORE using it or use a word you do know the meaning of instead? I pulled this from his second posting...

The all are NOS, none are repros tends to lend credence to your theory in that he appears to use NOS interchangably for original as opposed to what it truely means. That said, I think send me an offer and I'll tell you if I accept as opposed to here are the prices is an indicator of his main interest: maximizing his profits. Unless it's something truely rare or unique, I try to steer away from the items where the seller won't even indicate a price he wants to get. It might be pure coincidence, but those are the sales I always seem to have issues with. I still think the guys are right in that these marquees were represented to be in good/great condition and aren't. Check the posters prior pictures and judge for yourself.
 
Let me make one more point though, this is a collector's forum and (in my opinion) we are supposed to be looking out for each other. Misrepresenting the product you are selling while trying to squeeze top dollar out of it isn't looking out for your fellow collector, period. By the way, I didn't buy anything from him.
 
I received my marquee. I will say it was packaged extremely well. It also appeared to have some "older" bubblewrap at the innermost that could be 20+ years old.

Seeing the older bubblewrap made me believe the marquee really had been unused in storage.

Well, I wouldn't believe it's NOS, but it's not entirely terrible.

There are plenty of scratches, and some spots missing in the art. I'd guess, 5.5-6.5?

In hindsight I probably overspent.

Out of a 10 scale??? Unless your rating system is different than mine, the only thing a 6.5 would be fit for is display on my wall...
 
Mine had no "older bubblewrap" and even if it did, that's not NOS.

Given that he still insists these items are "as described NOS" and that he has "got no other complaints" except from me, that shows two outright lies right there. His most recent PayPal reply to me just moments ago repeats that. Add to that the fact that he says in his note to me in the box that these marquees are "unused" shows me he knows what NOS is. Add as well that I made my original offer after asking and having it confirmed that these marquees still had the protective paper on them. That was also a lie.

I will have to take some time to build a small webpage for this to show what I got sent to me. I got the pics, but been refurbishing a Battlezone today and have had no time to build this. It's going into part of my PayPal claim as I want a refund.

Same here. Good enough for the wall, but not to resell or put in machines.
 
I insist on seeing photos of the product before I consider purchasing anything online, no matter how good of condition the seller says the product is in. That's just me though. And yeah, I don't really like to make offers, just post a price. Anyway...good luck.

How anyone could consider those NOS, I have no idea...For the record, Foxen, this is what NOS means when you're trying to sell this kind of thing:

New old stock (abbreviated NOS) refers to merchandise being offered for sale which was manufactured long ago but that has never been used. Such merchandise may not be produced anymore, and the new old stock may represent the only market source of a particular item at the present time.

Well, PayPal screwed me and killed the claim, saying that I'm only protected against shipment of the items, not against the quality of the goods I was sent.

So basically, I was screeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeewed by Foxen... as were the rest of us who thought we were getting New Old Stock items.

It did say that if he gets more claims of the same thing that they will take some action, but that doesn't do much good unless ya'll all follow suit.

I suppose I will try to sell the shitty used marquees on eBay and recoup a fraction of my loss. Since I paid for the items with a bank transfer I will try to file a chargeback as well.
 
Well list out what you guys bought. I'm looking for wall art and may not need perfect condition pieces. Of course I won't be paying NOS prices this time....

To put it against his PayPal record, you gotta escalate it to a claim. They'll kill it like they did mine, but perhaps it'll help get him booted off.

If he doesn't come here to address and take care of us, however, I might just get upset enough to small claims this bad boy... it'd be worth the filing fee to me just out of the principal of it.
 
Glad I didn't buy any of the ones I was interested in.

Several things about this ad (and other ads) caused me to not try:

1) I've got a 100 things for sale, they're all pretty much the same, but you have to PM me a price. Um, no. If you have that much you want to sell, set a price, such as $10 each for these, $15 for these, etc. I pretty much ignore any For Sale listing that won't name a price. It means the seller is basically hoping for high bids and will sell the same item to two different people for two different prices. if that's your plan, put them on E-bay, not here....

2) The fact that the sale was time-limited. For some reason, this struck me as being a bit arrogant, and again was very much like an E-Bay auction. Like my mom says about garage sales: "If you want to sell it, price it to sell. If you don't sell it, then you priced it too high. If you don't want to sell it, leave it in the house. If you're not sure you want to sell it, leave it in the house. Don't put a sign on it that says 'make offer' in the hopes that someone will offer you a hundred bucks for it, because 99 times out of 100, you'll end up taking it back into the house at the end of the day."

I wish this Foxen guy would take full responsibility for his actions and at least refund a certain portion of our money. That's the right thing to do.

What pisses me off the most is that he declared a customs value of $100 US dollars when I paid $62 including the shipping and I ended up getting screwed for another $50 for dutie fees especially when I asked him to declare a lower dollar value or mark it down as a gift. And on top of all that he shipped them late.

This whole thing stinks to high heaven

Man, you HAVE to do the PP claim. Make sure you mention the NOS and forums. If we all put it, the person who goes through his history will key in on it.

It's very easy to do, just go to PP now and do it!
 
Yeah.. file the claim and be sure to escalate the claim. PayPal won't apparently give us shit for it, but hopefully enough flags on his account will at least make it hard for him to do this to others somewhere else.
 
Frizzle, you're an Idaho guy and know Foxen enough to somehow know he was out of town (earlier post), any chance you're in a position to step in and lend these guys some help??? Just a thought...
